Acceptable Use Policy

Prohibited uses of the Visibility Zone API and platform.

1. Purpose and Scope

This Acceptable Use Policy ("Policy") sets out the uses and conduct prohibited under the Terms of Service. This Policy applies to all customers, users, developers, and third parties accessing or using the Visibility Zone API, platform, and all related services and features.

Violation of this Policy may result in immediate suspension or termination of your account, removal of content, or law enforcement involvement.

2. Prohibited Content

You may not submit, upload, or analyse content that:

  • Illegal Material. Violates any applicable law, regulation, or statute, including content that promotes, facilitates, or describes the commission of illegal acts.
  • Child Sexual Abuse Material (CSAM). Contains, depicts, promotes, or facilitates child sexual abuse material in any form. Visibility Zone has a zero-tolerance policy for CSAM. Any suspected CSAM will be immediately reported to the National Center for Missing & Exploited Children (NCMEC), law enforcement, and other appropriate authorities. Your account will be permanently suspended and deleted.
  • Non-Consensual Intimate Imagery. Contains intimate images or videos of any person shared without their knowledge or consent, including so-called "deepfakes" or synthetic intimate content.
  • Malware and Harmful Code. Contains or is designed to distribute viruses, malware, ransomware, trojan horses, worms, spyware, adware, or any other harmful code or technology.

3. Prohibited Uses of the Analysis API

You may not use the Analysis API to:

  • Biometric Identification and Face Recognition. Perform biometric identification, face recognition, or facial analysis on photographs of living individuals without: (a) a documented lawful basis under applicable privacy law or law enforcement authority; and (b) the prior, explicit, documented written consent of the individual(s) whose biometric data is being processed. This prohibition applies regardless of how the images are obtained. Exception: You may use the API for your own face (e.g., self-portrait analysis or personal use) without consent.
  • Covert Surveillance. Conduct covert surveillance, tracking, or monitoring of individuals without their knowledge or consent, including through image or audio capture, analysis, or pattern recognition designed to track a specific person's location, movements, or behaviour.
  • Protected Decision-Making. Analyse images, audio, or text for the purpose of making, supporting, or automating employment decisions, educational admissions, credit or insurance eligibility, benefits determinations, or other consequential decisions affecting individuals' legal rights or access to services, without appropriate human review, transparency, and consent. This includes emotion inference, personality analysis, trustworthiness assessment, or other behavioural profiling used to make or inform such decisions.
  • Deanonymization. Re-identify or deanonymize individuals from anonymized datasets, images, or videos, or to reverse the process of anonymization or pseudonymization.
  • Unauthorized Scraping or Analysis. Analyse, process, or extract information from content (text, images, audio, video) that you do not have the legal right to analyse, including: (a) copyrighted material obtained without a licence; (b) proprietary content obtained without permission; (c) third-party websites or services in violation of their terms of service or robots.txt directives; or (d) private or confidential information obtained without authorization.
  • Unlawful Discrimination. Use Output to discriminate against, harass, or unfairly disadvantage individuals or groups based on protected characteristics including race, colour, ethnicity, national origin, caste, religion, sex, gender identity, sexual orientation, disability, age, or veteran status, in violation of applicable anti-discrimination law.
  • Harassment and Harm. Analyse or process content for the purpose of harassing, stalking, bullying, threatening, intimidating, or causing emotional harm to individuals.

4. Prohibited Uses of the Platform

You may not use the Visibility Zone subscription platform to:

  • Review Manipulation. Artificially inflate, suppress, or manipulate app-store reviews, ratings, customer feedback, or reputation metrics through fake reviews, paid reviews, coordinated campaigns, or misleading promotional activity.
  • Fake Mentions and Astroturfing. Create, amplify, or disseminate false or misleading mentions of your brand in reviews, social media, forums, or other public channels, or to impersonate genuine customer voices or third-party endorsements.
  • Impersonation. Monitor, track, or claim visibility for a brand, product, or service you do not own, operate, or have the legal right to represent, or to use the platform to impersonate or misrepresent your affiliation with that brand.
  • Harassment and Spam. Use the platform data to send unsolicited messages, spam, harassment, or threats to individuals, including authors of reviews or mentions.
  • Competitive Espionage. Attempt to obtain confidential business information, trade secrets, or competitive intelligence about a third party through the platform, beyond legitimate competitive monitoring.

5. Technical Restrictions

You may not:

  • Circumvent Rate Limits. Attempt to bypass, circumvent, or disable rate limits, throttling, quotas, or other technical restrictions we impose on API calls or platform access, including through proxy services, distributed requests, or credential sharing.
  • Unauthorized Reselling. Resell, redistribute, or re-offer raw API access, platform data, or analysis results as a service to third parties without a prior written reseller agreement with Visibility Zone. This includes offering white-label or private-label versions of the Services.
  • Reverse Engineering. Reverse engineer, decompile, disassemble, or attempt to discover the source code, algorithms, or methodologies underlying the Services, or to extract training data or model weights.
  • Benchmarking for Publication. Publish, share, or use Output from the Services for competitive benchmarking, research papers, performance comparisons, or public statements about the Services without prior written consent from Visibility Zone.
  • Unauthorized Security Testing. Conduct security testing, penetration testing, vulnerability assessment, or other security research on the Services or our infrastructure without prior written authorization from Visibility Zone.
  • Interfere with Service Integrity. Attempt to damage, disable, overburden, or impair the Services or our infrastructure, including through denial-of-service attacks, botting, or resource-exhaustion attacks.

6. Third-Party Terms and Data Retrieval

The Visibility Zone platform retrieves and observes publicly available data from third-party sources, including app stores, search engines, marketplaces, and AI assistants (such as ChatGPT, Google Gemini, Perplexity, and Google AI Overview). When we retrieve data on your behalf, you agree to:

  • Comply with the terms of service, privacy policies, and acceptable use policies of those third-party platforms.
  • Respect the robots.txt file and other technical directives published by website owners to control automated access.
  • Not use the platform to violate the intellectual property rights, confidentiality, or privacy obligations of third parties.

You are responsible for obtaining any necessary consents, permissions, or licenses required by those third-party terms before we retrieve or process data on your behalf.

7. Rate Limits and Fair Use

To ensure service availability and fairness, we impose rate limits on API calls and platform usage. You must not:

  • Exceed the rate limits specified in your account or Order Form.
  • Use the Services in a manner that unreasonably consumes resources, degrades performance for other users, or creates an operational burden.
  • Submit redundant, repetitive, or frivolous requests designed to consume quota without legitimate analytical purpose.

If you exceed rate limits, we may throttle your requests, temporarily suspend your account, or terminate your access. Repeated violations may result in permanent termination.

8. Reporting Abuse

If you discover a violation of this Policy, illegal activity, CSAM, or other abuse occurring on the Visibility Zone Services, please report it immediately to:

Include as much detail as possible, including account information, the specific content or activity, the date and time it occurred, and why you believe it violates this Policy. We will investigate all credible reports and take appropriate action.

Reports of CSAM will be immediately forwarded to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.

9. Enforcement and Remedies

Enforcement Actions. Visibility Zone may enforce this Policy through a graduated approach:

  • Warning. For first-time or minor violations, we may issue a written warning and require corrective action.
  • Throttling. We may reduce API rate limits or platform access speed to restrict the impact of ongoing violations.
  • Suspension. For serious or repeated violations, we may immediately suspend your account, disable API keys, or restrict your access pending investigation.
  • Termination. For severe violations, repeated breaches after warning, or violations involving illegal activity, harm to individuals, or CSAM, we may permanently terminate your account and delete all associated data without notice or refund.

Immediate Action. We reserve the right to take immediate action (suspension or termination) without warning if we reasonably believe you pose a legal or security risk, are engaged in illegal activity, or are violating this Policy in a severe or urgent manner.

Data Retention and Deletion. If your account is terminated for cause under this Policy, Visibility Zone may retain associated data and logs for legitimate legal, security, or law enforcement purposes.

10. Law Enforcement Cooperation

Visibility Zone cooperates with law enforcement, government agencies, and authorized legal processes. We may disclose your account information, activity logs, and content if required by law, court order, subpoena, or other lawful request. Where permitted by law, we will provide notice to you before disclosure.

You acknowledge that reports of CSAM will be immediately reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies.
